Legal basis for storing personal data

Under European law we have to tell you which of 6 ‘legal bases’ allow us to process personal data. We use contract, legal obligation and legitimate interests. We Fly Kites Inc do not process or store sensitive personal data.

What personal information we collect, where it comes from, why we collect it, who we share it with and how long we store it.

Personal data about our customers and potential customers

Where customers sign up to a third-party service or join an online social media group relating to our software they may be sent information relating to Breeze products and news by that service. We may be notified that you have signed up to third party services. We Fly Kites Inc has no control over the use these third parties make of your personal data, so any concerns should be taken up with them directly.

In the event that all or part of We Fly Kites Inc business and contracts are sold or transferred to a third party, relevant personal data described below may be transferred to that third party to allow them to fulfil customer contracts, confirm license ownership, confirm entitlement to use Breeze software and buy upgrades, ensure the software is used in accordance with the End User License Agreement, monitor and prevent fraud, and to protect their commercial interests as described below. This is a legitimate interest.

Order and subscription data

When you buy Breeze software licenses, order and subscription data is collected and passed to us by third party services Bluesnap Inc and PayPal, and by businesses selling Breeze software licenses packaged with other products. Order data may also be provided directly by customers.

This may include full name, postal address, email address, phone number, payment reference ID, payment method (usually card type* or PayPal), payment card expiry date, IP address and location, invoice ID, product purchased, tax paid, order date, registration data and additional comments on the order.

*We Fly Kites Inc never has access to full credit card numbers.

We store order data and emails about orders to fulfil the contracts we have with our customers. Data is used to generate licenses, confirm license ownership and entitlement to use software. We use data about old orders to check whether customers are entitled to order upgrade licenses. These are contractual uses of personal data.

We pass payment, VAT details, and copies of invoices to our company accountants to fulfil accounting and VAT requirements. This is a legal obligation.

We often provide more support than required by the contracts we have with our customers. Order data is often used to provide this support. This is a legitimate interest.

Our software licenses allow customers to buy upgrades many years after buying the original license. We may also provide support to customers many years after purchase. For this reason, we do not delete order data.

License, activation and user data

We record user details, license details and license activation history to fulfil the contracts we have with our customers. This data is also used to confirm that Breeze software is being used in accordance with the End User License Agreement. This is a legitimate interest. Details about license use are only shared in exceptional circumstances such as providing another member of the same business with records of their licenses, disputes about entitlement to use a license, and to identify or prevent abuse of the End User License Agreement.

Breeze iPad App user data is stored to enable Breeze App subscribers to manage user access to their Breeze licenses. User, license and activation data is also used to provide support and verify whether customers have a valid license many years after licenses are issued and activated. For this reason, we do not generally delete license and activation histories.

Emails sent to and from customers

We store copies of most emails you send us and our replies to help us provide future support, verify changes in license ownership, analyse and identify common issues and feature requests. This is a legitimate interest and for some emails a contractual obligation.

We do not delete most emails sent to or by We Fly Kites Inc as they help us provide our customers with long term support.

Contact forms

From time to time we may collect data through online or physical contact forms. We store data submitted via these forms to help us provide future support,  analyse and identify common issues and feature requests. This is a legitimate interest.

We do not delete contact form content sent to Breeze Systems as this helps us provide our customers with long term support.

Applications to join Apple beta programs

If you request to join a Breeze Apple beta test program, we collect your name and Apple ID email address. These are passed to the Apple Testflight program who invite you to join the program. This is a legitimate interest.

Your name and Apple ID email address may be stored on our computer systems for up to 3 months before they are deleted.

Notifications received from third party services

Online social services including WordPress, Facebook and Twitter may automatically notify us if you comment, ‘like’ a post, or start to follow us. These notifications may be stored on our computer systems for up to 3 months before they are deleted.

Personal data collected when our software is used

From time to time We Fly Kites may collect data about the use of Breeze software licenses when the software is being run. This is to ensure the software is used in accordance with the End User License Agreement, to monitor and prevent fraud and to protect our commercial interests. This is a legitimate interest. This data may be stored on our servers for up to five years before it is deleted.

Personal data we process and store to enable our software to share images

Breeze software may be used to share still, animated GIF and video images from events. We Fly Kites Inc have no access to or control over guest images or data generated by guests’ use of our software, with two exceptions:

  1. When images are shared by MMS and ‘SMS + Image’ using Twilio, the shared images are stored on Breeze servers for seven days and then deleted
  2. When customers use a Breeze managed email service to share images by email, the email is stored by our email provider for up to sixty days and then deleted. (Breeze do not store any personal data when images are shared using your own email provider).

For technical reasons images shared by MMS and ‘SMS + Image’ using Twilio are securely stored on We Fly Kites Inc servers. The mobile number is not stored on Breeze servers, which are hosted by an EU based ISP. Any reference to the event or individual source of these images in the filename is anonymised. The images are not viewed or used by We Fly Kites Inc, except to verify that the software is performing correctly. All such guest images stored on Breeze servers are deleted automatically after 7 days. This data is stored to fulfil our contracts with customers.

Some customers may share images using a Breeze email service instead of their own email provider. Where Breeze share emails on your behalf the email is stored by our email service for up to sixty days. These emails are not viewed or used by Breeze Systems, except to verify that the software is performing correctly. This data is stored to fulfil our contracts with customers.

How to ask us what information we hold, to correct any mistakes, or delete your personal data

You can ask us to tell you what personal data we hold about you. We will not usually charge to provide this information. Please email support@breezeys.com if you have questions, want to correct mistakes, update records or delete personal data we hold about you.

You can ask us to erase any personal data we hold about you. We will erase this data from our systems within one month with some exceptions. If we are not able to agree to your request, we will explain the reasons to you.
